How The Arizona Divorce Process Works

To file for divorce in Arizona, some basic steps must be followed:

  1. One spouse needs to be a resident here for at least 90 days
  2. File a “Petition for Dissolution”
  3. Have those documents served to the other spouse
  4. Discuss property division and parenting plans
  5. Wait for the court-ordered 60-day waiting period
  6. Finalize the divorce

In most cases, you are not required to provide a specific reason for wanting to end your marriage. Instead, you simply tell the court the marriage is irreversibly broken. However, some couples in Arizona face an extra hurdle: If you are in a covenant marriage, the “no-fault” divorce rule does not apply.

Do You Have a Covenant Marriage?

Arizona is one of three states which recognize covenant marriages. This is a level of commitment that makes divorce a little more complicated. Unlike standard legal marriages, the spouse filing for divorce in a covenant marriage must show grounds for ending the marriage, such as:

  • Adultery
  • Drug addiction or alcoholism
  • Abandonment
  • Physical abuse
  • Both spouses agreeing to the divorce
